IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Mr. Henely requested a stay to allow time for the parties to address jurisdictional matters in Superior Court. The Board agreed that a stay was appropriate. At a status conference held on June 5, 2008, the Administrative Law Judge informed counsel for the parties that a stay would not be granted unless they each agreed that the matter would be returned to the Board while the matters were pending in Superior Court. The parties each agreed to have the matter returned to the Board. Consequently, IT IS ORDERED vacating this matter from the docket of the Office of Administrative Hearings and returning it to Arizona Board of Nursing.
