On February 7, 2007, the Arizona Department of Real Estate filed a Notice of Settlement and Motion to Vacate Administrative Hearing with the Office of Administrative Hearings pursuant to which the Department advised that the parties have agreed upon a Consent Order being entered in this case. Hearing in this matter has been scheduled for March 12, 2007; no Notice of Hearing has been received by the Office of Administrative Hearings. Based on the foregoing, IT IS ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED remanding this matter to the Commissioner of the Department for further action.
