IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Complainant appeared through its c.e.o. and qualifying party, Bernard Adams (“Adams”) and Respondent was represented by its attorney, Kim Lough. Adams testified regarding his complaint that Respondent failed to pay a specified sum of money for work performed on Respondent’s construction project. During the course of cross-examination of Adams, he was shown by Respondent that Complainant’s own records indicated that Respondent had, in fact, overpaid Complainant by approximately $200.00. A recess was called in the hearing and Adams was allowed to check out Respondent’s numbers on the payment issue. Subsequent to having the opportunity to verify Respondent’s numbers, Adams indicated that he was withdrawing the filed Complaint. Based on Adams decision to withdraw the filed Complaint, it is hereby recommended that this matter be dismissed.
