Pending before the Office of Administrative Hearings is a Notice of Settlement and Request to Vacate Hearing submitted by the Arizona Department of Real Estate (the “Department”), through counsel, on November 16, 2006. Pursuant to that Notice, the Department has requested that the hearing in this matter, currently scheduled for November 17, 2006, be vacated for the reason that the parties have agreed upon a Consent Order being entered in this case. Good cause appearing, IT IS ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED remanding this matter to the Commissioner of the Department for further action.
