IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Findings of Fact 1. This matter came for hearing as scheduled. Prior to the receipt of any evidence, the parties agreed the matter had been settled. 2. The only item which remains to be completed by the Respondent is item nine of the Corrective Work Order “Roadway in front of lot #28 cracked and sunken”. The Respondent agrees to correct this problem by the end of February, 2007. Conclusions of Law 1. The parties are free to adjust their differences by entering agreements. 2. The settlement of the case is found to be reasonable and voluntary. 3. The rights and defenses are merged in the agreement, and the sole issue if there is to be any further action in the case, is whether the parties performed under the terms of the agreement.

Order It Is Ordered the hearing of this matter is vacated and the case is remanded to the agency for final disposition.
