Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was convened for administrative hearing in the Office of Administrative Hearings, Tucson. During the hearing a recess was called, and in the recess the parties achieved a settlement agreement which they wish to urge upon the Registrar as the final resolution of this case. The parties agreed as follows: (1) Respondent would pay the Complainant the amount of $750.00 as a full and final settlement of all matters within this Complaint, and (2) the Respondent may remit the payment to Complainant by mailing same to Complainant at the address stipulated by the parties in the hearing, which is 5819 E. Burns St., Tucson, AZ 85711.

The settlement was freely entered into by the parties, and the parties understood that, if it is approved by the Registrar, upon the Registrar’s receiving proof of the above payment being made, the matter will be closed as settled. The parties understood that all rights and defenses in this matter are merged into the settlement agreement, and any compliance hearing made necessary will be limited to the questions surrounding payment or non-payment. Wherefore, it is hereby ordered vacating this matter from the OAH docket and remanding same to the Registrar of Contractors with the recommendation that the Registrar approve and adopt the settlement agreement.
