The assigned Administrative Law Judge, having reviewed the file of the above-entitled matter makes the following minute entry: For good cause appearing, this matter is vacated from the docket of the Office of Administrative Hearings and remanded for the following reason: This matter is moot because Respondent has changed its position concerning the subject of the appeal. On February 25, 2005, Respondent notified the Tribunal that the parties had settled the matter and were expecting to” have final settlement documentation executed within the next day or two.” The party requesting the hearing has voluntarily withdrawn. The parties have resolved the matter. The agency deems allegations admitted and has issued Findings of Facts, Conclusion of Law and Order. The agency has dismissed the matter. The parties have agreed to dismiss this matter.
