Appellant Circle K Store No. 02885 has withdrawn its request for administrative hearing because it has reached an agreement with the Arizona Department of Environmental Quality regarding the State Assurance Fund Application Number at issue. Therefore, IT IS ORDERED that the hearing scheduled to convene on March 28, 2005 be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this appeal be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that it be dismissed pursuant to the terms of the parties’ settlement.
