On September 8, 2004, the undersigned Administrative Law Judge received a Notice of Settlement and Request to Vacate Hearing from Assistant Attorney General Mark Preny. Mr Preny requested that the hearing in this matter be vacated because the parties have settled their dispute. See, September 1, 2004 Consent Order.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for September 24, 2004, shall be vacated from the calendar of the Office of Administrative Hearings.
