Citation No. 17725 was set for hearing on February 23, 2005. The evidence established that Citation No. 17725 was issued on August 23, 2004. The Appellant failed to timely request a hearing pursuant to A.A.C. R-2-11-207. Pursuant to A.A.C. R-2-11-206, the Department of Administration/Capitol Police issued a Notice of Default on November 19, 2004. Upon the issuance of a Notice of Default, there are no issues pending before the Office of Administrative Hearings. The Office of Administrative Hearings has no jurisdiction over the instant matter and no action can be taken by the Administrative Law Judge. The Department of Administration’s Notice of Default stands.
