IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter is presently scheduled to be held in the Office of Administrative Hearings, Tucson, on April 26th, 2004. On March 15th, 2004, the Appellant filed a notice of settlement and withdrawal of its appeal against the decision taken by the Arizona Department of Environmental Quality, as well as its request to have the hearing on its appeal vacated. Considering the nature of the motion, no responsive pleading is required. Wherefore, good cause having been shown, it is hereby ordered, pursuant to A.A.C R2-19-111.3., that the administrative hearing of this matter is vacated, and the matter is remanded to the Arizona Department of Environmental Quality for its further action.
