IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Prior to the date of the scheduled hearing, Complainant filed a communication with the Office of Administrative Hearings, which provides, in part, as follows: “Comes now, William J. Yantis, the complainant herein, and moves for dismissal of the above entitled action for the reason that complainant no longer desires to prosecute this matter since his witnesses are unavailable to testify. It is therefore, respectfully submitted that the hearing date for December 3, 2002, be vacated and the matter be dismissed without prejudice.” Therefore, good cause appearing, the above-entitled case is vacated from the calendar of the Office of Administrative Hearings and it is hereby recommended that this Citation, together with the Complaint upon which it is based, be dismissed.
