This matter is presently scheduled for administrative hearing in the Office of Administrative Hearings, Tucson, on Tuesday, January 29th, 2002, at 1:30 p.m. The case brings allegations by the complainant against the respondent of failure to pay money for materials or services rendered, as set forth in A.R.S. 32-1154.11. Complainant mistakenly filed in the Registrar of Contractors office on January 22nd, 2002, a motion to vacate the hearing on the ground that he has now been paid by the respondent, and considers the matter “satisfactorily closed.” Complainant requested “that the hearing scheduled for January 29th, 2002, be canceled.” The motion was forwarded to the OAH by the ROC where it was filed that same day. A.A.C. R2-19-111.4. provides for the vacation of an administrative hearing if facts demonstrate to the administrative law judge that it is appropriate to do so for the purpose of informal disposition, and to further administrative convenience, expedition and economy. Such is the case here as the parties have settled their outstanding differences by tender and acceptance of payment. Wherefore good cause having been shown it is hereby ordered granting the motion to vacate the administrative hearing in this matter, and this case is returned to the Registrar of Contractors for any further action that might be necessary and appropriate.
