IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter is presently scheduled to be held in the Office of Administrative Hearings, Tucson, on April 11th, 2002. The complainant misfiled in the Registrar of Contractors’ office a motion to vacate the hearing on the ground that he has now been satisfied by the respondent. The ROC forwarded the motion to the OAH on the same day, where it was duly filed. Respondent has filed no response to the motion. A.A.C. R2-19-111.3. and .4. require an administrative law judge to vacate a calendared hearing and return the matter to the agency (Registrar of Contractors) for further action whenever the complainant withdraws the complaint, or vacating would be appropriate for the purpose of informal disposition, or to promote administrative convenience, expedition and economy, and doing so would not violate any law, or cause undue prejudice to any party. These are the present circumstances in the instant case. Wherefore, it is hereby ordered granting the complainant’s motion. The administrative hearing of this matter is vacated and the matter is remanded to the ROC for its further action.
