The administrative hearing of this matter is presently scheduled to be heard in the Office of Administrative Hearings, in Kingman, Arizona, on November 14th, 2002. On October 30th, 2002, complainant misfiled a motion to vacate the hearing in the Registrar of Contractors’ Kingman office. That motion was forwarded to the OAH by fax the same day. As ground for the motion complainant states that he wishes to vacate his hearing and have the complaint dismissed because respondent has filed bankruptcy, and respondent’s bond has been attached. Thus, complainant concludes that further effort in this matter would prove futile. Wherefore, good cause in support of the motion having been shown, and in accordance with A.A.C. R2-19-111.4., it is ordered granting the motion to vacate. The administrative hearing of this matter is vacated from the OAH docket, and the matter is returned to the Registrar of Contractors for its further action. Done this day, October 31st, 2002.
