On April 24, 2002, at 9:00 a.m., a disciplinary hearing was scheduled in this matter. Shortly before convening the hearing in this matter, the undersigned Administrative Law Judge received a facsimile letter from Complainant Mary Hustead requesting to withdraw the complaint in this matter. The undersigned Administrative Law Judge shall treat this letter as a Motion to Vacate the hearing in this matter.

Attorney Jeffery M. Hall, Mr. David Halls, Mr. Michael Bertola Bufftech and ROC Inspector Bob Mechsner appeared at the scheduled time for the hearing in this matter. Attorney Jeffery M. Hall objected to Complainant Hustead’s Motion to Vacate. Attorney Jeffery M. Hall also requested that this matter be dismissed with prejudice.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled in this matter for April 24, 2002, at 9:00 a.m. shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter shall be remanded to the Registrar of Contractors for any further action deemed necessary by the Registrar.
