Appellant Circle K Store #0163 has filed a request to vacate the scheduled hearing due to having reached a settlement agreement with the Arizona Department of Environmental Quality. In view of the foregoing, IT IS ORDERED that the hearing scheduled for April 4, 2002 shall be vacated from the docket of the Office of Administrative Hearings. This matter is remanded to the Director of the Arizona Department of Environmental Quality for any further action deemed appropriate. Done this day, March 5, 2002.
