IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On March 14, 2002, Appellant filed a letter with the Arizona Department of Environmental Quality withdrawing the request for a formal appeal and stating that the Appellant has reached an agreement with the Department. The Office of Administrative Hearings received a copy of the letter in question. Based on the above, IT IS ORDERED that the hearing set for April 5, 2002 be vacated from the calendar of the Office of Administrative Hearings and it is hereby ordered that this matter be remanded to the Arizona Department of Environmental Quality for further action consistent with parties’ settlement agreement.
