IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter is presently scheduled to be held in the Office of Administrative Hearings, Tucson, on March 18th, 2002, at 9:00 a.m. The appellant, Sterling Hundley, filed a motion to vacate the hearing based on his having achieved a settlement agreement with the Department of Environmental Quality. The department forwarded the motion to the OAH with its cover letter, without objection to the motion. Wherefore, good cause being shown and pursuant to A.A.C. R2-19- 111.3., the administrative hearing of this matter is vacated from the OAH calendar and the matter is returned to the Arizona Department of Environmental Quality for any further action that might be necessary and appropriate.
