These matters were originally set for consolidated formal administrative hearing to be held on January 29, 2002 at the Arizona Office of Administrative Hearings pursuant to the Complaint and Notice of Public Hearing issued by the Arizona State Board of Accountancy (Board) on October 22, 2001. Respondent Young’s ex-parte Letter Motion to Continue was Denied by Order dated January 28, 2002. After close of business, on January 28, 2002, the Board filed a Motion to Continue the matters, indicating that an extreme unexpected medical emergency had arisen, preventing the Board’s counsel from preparing and representing the matters at hearing. On Motion argument on January 29, 2002, despite Respondent’s default in appearance, the Board urged the matters be continued, indicating that, due to the additional nature of the criminal matter pending for Respondent, the Board did not object to a continuance. The matters were Continued by Order dated January 31, 2002 for a formal administrative hearing to be held on April 17, 2002. On April 8, 2002, Respondent Young filed a letter to the Board, and copied this Tribunal, requesting that the hearing scheduled for April 17, 2002 be postponed until after June. /// On April 16, 2002, Counsel for the Board filed a Motion to Vacate the Hearing and Remand the matters to the Board. Counsel attached Respondent’s April 12, 2002 Affidavit setting forth his waiver of rights to a prompt public hearing regarding the suspension of his CPA certificate and asking that the matters be remanded to the Board pending resolution of the court criminal matter. Based on the foregoing, IT IS ORDERED the Board’s Motion to Vacate is GRANTED, and these matters are Remanded to the Board for further handling. ORDERED and DATED this day, April 17, 2002.
