On December 11, 2002, the Arizona Department of Real Estate, by and through Assistant Attorney Craig A. Raby, informed the Office of Administrative Hearings in writing that the Department had entered into a CONSENT ORDER with the Petitioner hereto whereby Petitioner has waived his right to a hearing in consideration for the Department’s granting Petitioner a provisional real estate salesperson’s license. The Department’s issuance of the CONSENT ORDER, and Petitioner’s acknowledged acceptance of the terms thereof, has effectively rendered moot all issues raised by this appeal. Therefore, necessity for a hearing has been obviated. IT IS HEREBY ORDERED that this matter be vacated from the December 13, 2002 hearing docket of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter be remanded to the Arizona Department of Real Estate for further disposition.
