IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter was scheduled to convene in the Office of Administrative Hearings, in Yuma, on Tuesday, September 25th, 2001, at 8:30 a.m. On Friday, September 21st, 2001, the complainant filed in the OAH a motion to vacate the hearing stating that they had received full payment from the respondent, and therefore no longer wished to continue with the complaint process. The respondent had no objection to the motion. The parties were notified telephonically that day by the OAH that the motion was granted A.A.C. R2-19-111.1 requires an administrative law judge to vacate a calendared hearing and return the matter to the agency for further action if the parties agree to vacate the hearing. Wherefore, good cause having been shown, the complainant’s motion is granted and the administrative hearing of this matter is vacated nunc pro tunc, and the matter is returned to the Registrar of Contractors for any further action that might be necessary and appropriate with a recommendation for closure in a manner to be determined by the registrar.
