VACATE

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter is presently scheduled to convene on Wednesday, October 3rd, 2001, in the Office of Administrative Hearings, Tucson. The case is to do with the complainant’s complaint against the respondent for failure to pay for goods or services, which resulted in the issuance of a Citation and Complaint from the Registrar of Contractors for possible violations of A.R.S. 32-1154.A.7., and 11. The complainant filed in the ROC office on July 26th, 2001, a letter informing the registrar that he no longer had a complaint against the respondent, since respondent had given the complainant a cashier’s check for the amount claimed. The letter was forwarded to the OAH by the ROC on July 31st, 2001. The letter signifies a motion to vacate. The OAH forwarded the motion to vacate to the respondent for its response, and allowed that party until August 13th, 2001, to make response. Respondent filed no response. The present circumstances constitute good grounds to vacate the administrative hearing pursuant to A.A.C. R2-19-111.4. Wherefore, it is hereby ordered that the administrative hearing of this matter is vacated, and the matter returned to the Registrar of Contractors for any further action that might be necessary and appropriate, with a recommendation for closure in a manner to be determined by the registrar.
