IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter is presently scheduled for administrative hearing in the Office of Administrative Hearings, Tucson, on February 13th, 2001. The parties filed in the OAH on February 2nd, 2001, a Stipulation to Vacate this administrative hearing. The ground for the parties’ stipulation is that they have decided to pursue their legal remedies in Superior Court in and for the County of Pima. They have in fact instigated proceedings in that forum, it having cause number C20004317. The parties request that this matter before the registrar be dismissed without prejudice. A.A.C. R2-19-111.1. provides that an administrative law judge shall vacate a calendared hearing and return the matter to the Registrar of Contractors for further action if the parties agree to vacate the hearing. Wherefore, it is ordered that this matter is vacated from the calendar of the Office of Administrative Hearings, and Case No. T01-0020 is returned to the registrar for further action, with a recommendation that the matter be dismissed without prejudice.
