Prior to the date of the scheduled hearing, Complainant filed a motion to vacate and remand to agency, indicating that there were developments in the underlying case that might have a direct bearing on whether or not it wished to proceed with the instant matter. In said motion, Complainant further averred that it discussed the motion to vacate and remand with counsel for Respondent and that Respondent was in agreement with the motion. Therefore, good cause appearing, the above-entitled case is vacated from the calendar of the Office of Administrative Hearings and remanded back to the referring agency for appropriate disposition.
