Hearing in this matter began on January 16, 2002, but did not conclude. Further hearing has been set for April 11, 2002. On March 5, 2002, the parties filed a Stipulation for Dismissal with Prejudice because they came to an agreement that makes an administrative hearing unnecessary. The Stipulation applies to all claims and counterclaims in these consolidated matters. The agreement, a copy of which was faxed to this tribunal on February 28, 2002, essentially provides that upon the payment of $21,765.09 from JAC to CPI, the parties release each other from all claims regarding the two projects that are at issue here.

RECOMMENDED ORDER Based on the parties stipulation, IT IS RECOMMENDED that the Registrar of Contractors dismiss complaints G01-1184 and M01-1479.
