HEARING: June 8, 2001 APPEARANCES: Neither Complainant William Guendling nor any person on his behalf arrived for the hearing. No person appeared on behalf of Johnny Lee’s Mobile Home Set- Up and Service. ADMINISTRATIVE LAW JUDGE: Kay A. Abramsohn _____________________________________________________________________ The above-captioned matter came to hearing on June 8, 2001, at 9:00 a.m., pursuant to Notice of Hearing issued by the Arizona Department of Building and Fire Safety, and duly sent to both parties on April 11, 2001. The Department’s May 1, 2001 request to vacate the matter was returned to the Department, as the Department is not a named party in this matter. No other request for either a continuance or a vacate was received from either named party. Although the start of the scheduled hearing was delayed for approximately 15 minutes to afford added time in which the parties could make an appearance, neither party arrived for the hearing. By his default in appearance at the hearing, the Complainant failed to sustain the required burden of proof. Based on the foregoing, IT IS RECOMMENDED that Complainant’s appeal regarding Verified Complaint Item 23 be denied for failure to pursue the appeal and failure to sustain his burden of proof. RECOMMENDED and DATED this day, June 22, 2001.
