IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter is presently scheduled to be held in the Office of Administrative Hearings, Tucson, on Monday, April 16th, 2001, at 9:00 a.m. The Department of Building and Fire Safety filed in the OAH on March 27th, 2001, a motion to vacate the hearing pursuant to A.R.S. 41-1092.06, on the ground that the parties had achieved settlement informally. A.A.C. R2-19-111.4. requires an administrative law judge to vacate a calendared hearing and return the matter to the agency for further action if facts demonstrate to the judge that it is appropriate to do so for the purpose of informal disposition, and to further administrative convenience expedition and economy. Wherefore, good cause having been shown, the motion is granted and the administrative hearing of this matter is vacated from the calendar of the OAH, and returned to the Department of Building and Fire Safety for any other actions that might be necessary and appropriate.
