STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Shortly prior to the date and time set for the hearing in the above- entitled matter, counsel for the Arizona State Banking Department (the “Department”) filed a motion to vacate the scheduled hearing based upon the concluding of a settlement between the parties, confirmed in writing by counsel for Petitioners, effectively resolving all matters in issue and requesting that the pending administrative action be dismissed from this tribunal’s docket.

In view of the foregoing, and sufficient cause otherwise appearing herein, IT IS ORDERED that the hearing scheduled to convene on Friday, April 20, 2001 be and hereby is Vacated and dismissed from the calendar and the docket of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Superintendent of the Department with the recommendation that the entire administrative action be terminated.
