IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On January 14, 2002, the Office of Administrative Hearings received a copy of a letter authored on “Mike’s Construction” letterhead, dated December 13, 2001, by Victor V. Vaz, to Complainant Paul Glonek. The letter, which is also signed by Mr. Vaz, spells out an agreement apparently reached between the Complainant and Respondent Mike’s Construction in regards to this case. The agreement states that “upon cashing” Mr. Glonek’s check #884, for $1,800.00, payable to Mike’s Construction, Mike’s Construction has closed Mr. Glonek’s “balance at zero”, agreeing that the balance in the account has been paid in full. The letter also states that Mr. Glonek agrees with the terms of the letter, and Mr. Glonek therefore requests that the “complaint with the Registrar be dismissed.” Below this part of the agreement, there are signature and date lines which have been signed presumably by Mr. Glonek and dated “December 16, 2001.” Based on the foregoing, and good cause appearing, IT IS HEREBY ORDERED vacating this matter from the docket of the Office of Administrative Hearings, with the recommendations that the Registrar of Contractors impose no discipline against the Class C-36 License (No. 062676) and that it close the entire Citation and Complaint issued in this matter.
