IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On February 7, 2002, a prehearing status conference was conducted at the Office of Administrative Hearing. The Arizona Board of Medical Examiners was represented by Assistant Attorney General Dean E. Brekke. The Respondent was represented by his attorney, Calvin L. Raup, Esq. Counsel advised the tribunal that they had made substantial progress towards reaching a settlement. Counsel presented facts which demonstrate to the undersigned Administrative Law Judge that it is appropriate to vacate the scheduled hearing for the purpose of informal disposition. Counsel agreed with that assessment. Pursuant to A.A.C. R2-19-111, IT IS ORDERED that the hearing set for March 26 through 29, 2002, be vacated from the calendar of the Office of Administrative Hearings, and that this matter be remanded to the Arizona Board of Medical Examiners for informal disposition. If any issues cannot be resolved, the matter may be resubmitted to the Office of Administrative Hearings. Done this day, February 7, 2002.
