IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On October 4, 2001, the hearing of this matter convened. Complainant Steven Zahnow was represented by counsel Bradley Johnston. Respondent Zahnow Homes was represented by counsel Joe Kreamer. At the outset of the hearing, the parties through their respective counsel informed this tribunal that they have agreed to resolve their differences through private mediation. The parties further agreed to a dismissal of this matter without prejudice. As a result of the stipulation to dismiss this matter without prejudice, there was no need to proceed further with the hearing. In view of the foregoing, it is recommended that the Director of the Registrar of Contractors dismiss this matter subject to Complainant’s right to seek further relief from the Registrar of Contractors should the parties’ efforts at mediating their dispute fail.
