IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter is presently scheduled for hearing in the Office of Administrative Hearings, Tucson, on April 12th, 2001. The appellant filed in the OAH on March 12th, 2001, a notice of settlement in this case, stating that the parties have achieved settlement in the amount of $52.92. A.A.C. R2-19-111.4. requires an administrative law judge to vacate a calendared hearing and return the matter to the agency for further action if the facts demonstrate that it is appropriate to vacate the hearing for the purpose of informal disposition, and to further administrative convenience. Wherefore, good cause having been shown, it is hereby ordered that this mater is vacated from the OAH docket and returned to the Arizona Department of Environmental Quality for any further action that might be necessary and appropriate.
