On December 14, 2001, the Office of Administrative Hearings (Office) received Petitioner’s Motion to Vacate the hearing of this matter for the reason that Petitioner discovered the existence of an additional creditor and is involved in settlement discussions. The Arizona Department of Insurance has no objection to the Motion. Petitioner requests that the hearing be vacated subject to being rescheduled at a later date and time upon request of the Petitioner. Good cause is presented for this matter to be vacated from the Office’s docket. Once vacated, Petitioner will have to contact the Arizona Department of Insurance concerning a future hearing and the Department will then have to file a request for hearing with the Office for this matter to return to the Office’s docket. Based on the above, IT IS ORDERED vacating this matter from the docket of the Office and remanding it to the Arizona Department of Insurance Done this day, December 18,2001.
