STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Shortly prior to the date set for the hearing in the above-entitled matter, the named Petitioner filed written confirmation that he no longer desired to pursue the matter of the denial of his pending license application, thereby formally withdrawing the previously filed appeal, also effectively requesting that the scheduled hearing be vacated and that the pending administrative action be terminated. In view of the foregoing, and sufficient cause otherwise appearing herein, IT IS ORDERED that the hearing scheduled to convene on October 29, 2001 at 9:00 a.m. be and hereby is Vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Insurance with the recommendation that the entire appeal action in this case be dismissed and that the Department’s prior denial action be affirmed.
