The hearing of this matter convened on April 13, 2001 at approximately 10:30 a.m. Capitol Police Officer Mario Trevizo (“Officer Trevizo”) appeared on behalf of the Capitol Police, Department of Administration. Appellant Jay Montoya appeared on his own behalf. At the outset of the hearing, Officer Trevizo made a motion to dismiss the instant citation issued to Mr. Montoya. Based upon the above, IT IS ORDERED that no penalty be imposed against Appellant and that citation no. 12042 be dismissed. Done this day, April 16, 2001.
