This matter involves a request for hearing from the imposition by the Arizona Registrar of Contractors (“Registrar”) of a civil penalty for a violation of Arizona Revised statutes (“A.R.S.”) § 32-1151 (Engaging in contracting without a license). The Registrar issued a citation and assessed a civil penalty of $2,500.00. The matter was set for hearing on August 24, 2000. On August 23, 2000, Mr. Dobkin telephoned the Office of Administrative Hearings to advise that he wished to vacate the hearing and that he would pay the civil penalty assessed by the Registrar. At the hearing, Assistant Attorney General Mary D. Williams, Esq., representing the Registrar, appeared and avowed that Mr. Dobkin had informed her also that he did not wish to proceed with the hearing and that he would pay the civil penalty. The Administrative Law Judge (“ALJ”) telephoned Mr. Dobkin at the telephone number he had left. Mr. Dobkin did not answer. The ALJ left a message confirming that Mr. Dobkin had requested to vacate the hearing and would pay the civil penalty. RECOMMENDED ORDER It is recommended that the Registrar deny this appeal for lack of prosecution and commence the process to collect the civil penalty from Mr. Dobkin.
