HEARING: August 29, 2000 APPEARANCES: Defendant did not appear. Assistant Attorney General Mary D. Williams was present of behalf of the Registrar of Contractors. ADMINISTRATIVE LAW JUDGE: Sondra J. Vanella _____________________________________________________________________ Having considered the entire record in this matter, the undersigned Administrative Law Judge hereby makes the following Findings of Fact and Conclusions of Law and submits the following Recommended Order to the Director of the Arizona Registrar of Contractors. FINDINGS OF FACT 1. Assistant Attorney General Mary Williams avowed to this tribunal, that prior to the commencement of the instant hearing the parties concluded a settlement agreement, the essential terms of which were read upon the record. 2. The terms of the aforementioned settlement agreement are as follows: c. Defendant has obtained the necessary licensure from the Registrar of Contractors; d. The Registrar of Contractors has agreed to reduce the civil penalty from $1,000.00 to $200.00; e. Defendant has agreed to pay the $200.00 civil penalty; and f. Defendant has agreed to withdraw its request for a hearing in this matter. 3. The terms of the foregoing settlement appeared to be reasonable under all the circumstances and the agreement was determined to be the product of knowing and voluntary action on the part of each party. CONCLUSIONS OF LAW 1. The policy of the law favors settlements of disputes and adverse parties should be free to adjust their differences by entry into agreements or stipulations of settlement which should be recognized and given effect by all tribunals. 2. The settlement reached prior to and submitted during the hearing of this matter, having been found to be reasonable and voluntarily made, warrants the termination of the instant hearing. RECOMMENDED ORDER In view of the foregoing, it is recommended that this matter be dismissed.
