IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was scheduled for hearing on May 4, 2000 at 8:30 a.m., on April 21, 2000 the Complainant filed a request to withdraw its complaint, without prejudice, pending the filing and outcome of civil action against the Respondent with the intent to file a new complaint if a judgment is obtained. The Respondent filed a response in objection to any dismissal without prejudice. In view of the foregoing and after a full review of the entire file herein , sufficient cause appearing, IT IS HEREBY ORDERED that the hearing scheduled to convene on May 4, 2000 be and hereby is vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Registrar of Contractors with the recommendation that this Citation, together with the Complaint upon which it is based, be dismissed without prejudice.
