This matter came on for a Compliance Hearing to determine whether the Respondent has substantially complied with the terms and conditions of the previously entered Decision and Order of the Registrar of Contractors. Evidence and testimony were presented and, based upon the entire record, the following Findings of Fact, Conclusions of Law and Recommended Order on Compliance Hearing are made: FINDINGS OF FACT 1. The prior Order of the Registrar of Contractors, which has become final in the absence of any timely appeal, provides for the suspension of the Respondent’s Class B- License No. 145807 unless or until the Respondent has properly performed designated corrective action on the Complainant’s residence. 2. The assigned agency inspector testified that the concrete driveway had been replaced and that the wall texture patch had been corrected but that he was still concerned about the workmanship on the sliding glass door installation. 3. Both the Complainant and the Respondent agreed that the Respondent did perform corrective work on the sliding glass door after the assigned agency inspector’s prehearing inspection and that the concrete around the door has been corrected and that the sliding glass door has now passed a water inspection. 4. Credible evidence, presented at hearing, adequately established that the corrective actions set forth in the prior Order of the Registrar of Contractors have been completed to within applicable industry standards and the Respondent has substantially complied with the terms and conditions of the prior agency Order in this matter. CONCLUSIONS OF LAW 1. The credible evidence of record established that the Respondent has substantially complied with the terms and conditions of the prior Order of the Registrar of Contractors. 2. The license suspension imposed on the Respondent’s Class B- License No. 145807 was lifted and the Respondent’s License was reinstated on January 29, 2001 per Order of the Registrar of Contractors. RECOMMENDED ORDER on compliance hearing In view of the foregoing, it is recommended that Citation No. T00- 0245 be closed. Done this day, June 27, 2001.
