STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The above-entitled matter came on for hearing on March 7, 2000. The Registrar of Contractors was represented by Assistant Attorney General, Mary DeLaat Williams, Esq., and the Respondent was represented by its attorney, Kent A. Lang, Esq.

At the outset of the scheduled hearing, counsel for both parties joined in a request to continue this matter so as afford additional time for the agency to further review documents recently made available by Respondent to the Registrar for consideration and possibly favorable action.

Under all the circumstances, the Administrative Law Judge did not find that a granting of the much belated request for a continuance was warranted. However, after discussion, it was mutually agreed that this administrative action would be promptly remanded to the Director with a recommendation that the Registrar enter an Order provisionally or conditionally closing the Citation and Complaint in this matter. In effect, the case would be closed automatically on the Order’s effective date unless on or before a stipulated deadline date, March 31, 2000, counsel for the Registrar files a written request to restore this matter to the calendar of the Office of Administrative

Hearings for a determination of the merits, in which event the parties would be notified of the place, date and time of the hearing.

Accordingly, IT IS HEREBY ORDERED that this matter be remanded to the Registrar of Contractors with the express recommendation that the entire Citation and Complaint in Case Number R00-0021 be automatically closed on the effective date of the Registrar’s Order, provided however that if, on or prior to March 31, 2000, counsel for the Registrar files a written request to restore this case to the hearing calendar, the matter shall not be treated as closed, but instead this case shall be scheduled for hearing on the merits in the normal course of docketing in the Phoenix area.
