ADMINISTRATIVE LAW JUDGE: Brian Brendan Tully _____________________________________________________________________ At the outset of the scheduled hearing the Complainant, through counsel, requested that the Citation and Complaint in this matter be dismissed without prejudice to the Complainant later timely refiling his complaint against Respondent with the Registrar of Contractors. Complainant desires to attempt to resolve his dispute with the Respondent in the parties’ pending civil litigation. Respondent had no objection to the Complainant’s request. Upon review and consideration of the Complainant’s request and Respondent’s lack of opposition to it, as well as of the entire record in this matter, it is recommended to the Registrar of Contractors that the Citation and Complaint in this matter be dismissed without prejudice.
