IN THE OFFICE OF ADMINISTRATIVE HEARINGS

AAA Action Drywall and Plastering Co. (“AAA”) has filed notice of his previously filed petition in bankruptcy in U.S. District Court case no. 00- 00280-RTB and that as a direct result thereof, there now exists an automatic stay of proceedings pursuant to 11 U.S.C. §362(a). Via telephonic communication, AAA advised that he was seeking dismissal of both of the above captioned matters due to the bankruptcy filing. Travelers Construction Co. (“Travelers”) has received notice of Respondent’s claim referable to the bankruptcy. In light of the fact that the above-captioned matters involve cross complaints by the respective Complainants, it is determined that both are necessarily affected by the automatic stay. Therefore, good cause appearing, the above-entitled cases are vacated from the calendar of the Office of Administrative Hearings and it is hereby recommended that these Citations, together with the Complaints upon which they are based, shall be closed unless Travelers files notice with the Registrar of Contractors on or before the effective date of the Order entered in this matter that it has instituted proceedings before the appropriate Federal Court seeking relief from the aforesaid automatic stay.
