HEARING: December 6, 2000 APPEARANCES: No person appeard on behalf of Complainant Mohave Built In Systems. Respondent Michael Raymond Dom appeared, representing himself.

ADMINISTRATIVE LAW JUDGE: Kay A. Abramsohn _____________________________________________________________________ FINDINGS 1. The above-captioned matter came to hearing on December 6, 2000, at 1:30 p.m. in Kingman, Arizona, pursuant to the Notice of Hearing issued by the Arizona Registrar of Contractors (Registrar) and duly sent to both parties on August 22, 2000. 2. Although the start of the scheduled hearing was delayed for approximately 15 minutes to afford added time in which to make an appearance, the Complainant did not appear. 3. On review of Registrar’s records, the Registrar’s Inspector advised that the Noticed address of Complainant was correct, but further indicated that the Complainant’s License was delinquent and suspended. Such license status may explain Complainant’s absence at the hearing.

4. At the hearing, Respondent testified under oath that the allegations made by Complainant were false, in that he was not involved in either pre-plumbing or central vacuum systems. 5. The record, as provided to this tribunal by the Registrar, was reviewed.

CONCLUSION By Complainant’s default in appearance at the hearing, the Complainant has failed to sustain the required burden of proof as to allegations made in his filed complaint and in the Registrar’s Citation and Complaint. RECOMMENDATION Based on the foregoing, IT IS RECOMMENDED that this particular case be dismissed with prejudice, and the matter closed within the Registrar’s files. RECOMMENDED and DATED this day, December 20, 2000.
