At the outset of the scheduled hearing, Complainant testified that it received information from the Registrar of Contractors indicating that Respondent had recently filed a petition in bankruptcy in U.S. District Court. Respondent confirmed this fact. As a direct result thereof, there now exists an automatic stay of proceedings against Respondent pursuant to U.S.C. §362(a). Therefore, based on the foregoing, it is hereby recommended that this Citation, together with the Complaint upon which it is based, shall be closed unless Complainant files notice with the Registrar of Contractors on or before the effective date of the Order entered in this matter that it has instituted proceedings before the appropriate Federal Court seeking relief from the aforesaid automatic stay.
