On August 7, 2000, the parties appeared at the appointed time and place for hearing in this matter. No hearing was held on the record, because the parties, with help from the Administrative Law Judge, came to an agreement that makes an administrative hearing unnecessary. The parties verbally agreed under oath and on the record to terms that are recited below and incorporated herein by reference. Respondent has not disputed that he owes Complainant money under the dictates of A.R.S. § 32-1154(A)(11). At the August 7, 2000, hearing, Respondent handed Complainant’s representatives $1000 in cash. Furthermore, Respondent stated that he would pay the remaining balance, $4444.58, on or before the close of business September 7, 2000. (Exhibit 1.) If Respondent does not pay the full amount by then, Respondent agrees that his license be suspended until he pays the entire amount noted above. Complainant agreed, through its representatives, to drop the complaint if Respondent pays the entire amount by that time. The parties expressed their agreement to these terms verbally on the record.
RECOMMENDED ORDER IT IS RECOMMENDED that the Registrar of Contractors accept the settlement terms agreed to by the parties and order that Respondent’s Class B license 121470 be suspended starting September 8, 2000, unless Respondent pays Complainant $4444.58 by September 7, 2000. If Respondent fails to do so, Respondent’s license shall remain suspended until Respondent has paid the full amount.
