HEARING: September 13, 2000 APPEARANCES: Complainant, the City of Flagstaff, was represented by Building Official, Wayne Hellwig. Respondent, Redi Plumbing and Rooter Service, Inc., was represented by its owner Ruben Yubeta ADMINISTRATIVE LAW JUDGE: Sondra J. Vanella _____________________________________________________________________ Having read and considered the entire record in this matter, the undersigned Administrative Law Judge hereby makes the following Findings of Fact and Conclusions of Law and submits the following Recommended Order to the Director of the Arizona Registrar of Contractors. FINDINGS OF FACT 1. Following a discussion between the parties, prior to commencing the instant hearing, the parties concluded a settlement agreement, the essential terms of which were read upon the record. Pursuant to the terms of the aforementioned settlement agreement, Respondent agreed to have the following completed within five working days of September 13, 2000:

c. correct all work in question; d. schedule the inspections of the aforementioned work with the homeowners and the City of Flagstaff; and e. have all inspections performed by the City of Flagstaff. 3. The terms of the foregoing settlement appeared to be reasonable under all of the circumstances and the agreement was determined to be the product of knowing and voluntary action on the part of each party. CONCLUSIONS OF LAW 1. The policy of the law favors settlements of disputes and adverse parties should be free to adjust their differences by entry into agreements or stipulations of settlement which should be recognized and given effect by all tribunals. 2. The settlement reached and submitted during the hearing of this matter, having been found to be reasonable and voluntarily made, warrants the termination of the instant hearing. RECOMMENDED ORDER In view of the foregoing, it is recommended that Citation Nos. F00- 0212, F00-0213, F00-0214, F00-0215, and F00-0217, together with the Complaints upon which they are based, be dismissed. Done this day, September 20, 2000.
