ADMINISTRATIVE LAW JUDGE: Anthony Halas _____________________________________________________________________ The above-entitled matter came on for hearing on July 10, 2000, at 1:30 p.m., pursuant to advance notice duly sent to both parties. Although the start of the scheduled hearing was delayed for approximately 15 minutes to afford added time in which to make an appearance, no one appeared on behalf of Complainant Kona in Sedona, nor was any information received to explain the absence of any representative for Complainant. Therefore, by the aforementioned default in appearance at the hearing, Complainant Kona in Sedona has failed to sustain the required burden of proof. Accordingly, it is recommended that the Citation in Case No. F00-0180, and the complaint upon which it is based, be dismissed. Done this day, July 17, 2000.
