IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Prior to the date set for the hearing in the above-entitled matter, counsel for the Arizona State Banking Department (herein called the “Department”) filed a motion to vacate the scheduled administrative hearing in the above-entitled matter, confirming that the named Respondent/Petitioner has withdrawn its request for a hearing, thereby effectively requesting that the pending administrative action be terminated.

In view of the foregoing, and sufficient cause otherwise appearing herein, IT IS ORDERED that the hearing scheduled to convene on June 13, 2000 be and hereby is vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Superintendent of the Department with the recommendation that the entire appeal action in Case Number 00F-BD022-BNK be dismissed.
