HEARING: December 26, 2000 APPEARANCES: Neither Complainant nor Respondent arrived for the hearing. ADMINISTRATIVE LAW JUDGE: Kay A. Abramsohn _____________________________________________________________________ FINDINGS 1. The above-captioned matter came to hearing on December 26, 2000, at 9:00 a.m. in Phoenix, Arizona, pursuant to the Notice of Hearing issued by the Arizona Registrar of Contractors (Registrar) and duly sent to both parties on October 26, 2000. 2. Although the start of the scheduled hearing was delayed for approximately 15 minutes to afford added time in which to make an appearance, neither Complainant nor Respondent appeared for the scheduled hearing. 3. It is presumed that the addresses used by Registrar for its Notice of Hearing were the addresses of record at the Registrar’s offices, and that the parties received those Notices and chose, for whatever reason, not to attend the scheduled hearing in this matter. This tribunal has not received any indication that this matter was settled by the parties prior to the hearing time. CONCLUSION By Complainant’s default in appearance at the hearing, the Complainant has failed to sustain the required burden of proof as to any allegations made in its filed complaint and contained in the Registrar’s Citation and Complaint issued on September 25, 2000. RECOMMENDATION Based on the foregoing, IT IS RECOMMENDED that this particular case be dismissed with prejudice, and the matter closed within the Registrar’s files. RECOMMENDED and DATED this day, December 26, 2000.
